I am seeking references to case law concerning condemnation of trees. Specifically , a municipality is condemning a property. The owner and the municipality disagree on the value of the trees on the property not the property itself.

Hi Jerry,
See, if my book was out, we may have some references to this. I have not had any experience in the condemnation of trees, but I have done appraisals to be used against municpalities (actually state roads) and even been to court on such when people have been short changed in their tree evaluations. I'm sure that each state has different rules, but a court case, or threat thereof, is probably warranted.
