I'm not sure if you can help us, but we have a major problem. While the developer building houses on the land next to us has promised to try and save as many trees as possible on that plot (which is not happening but that's another issue), his proposed driveway is endangerig the life of an incredible oak on our property. It is easily 200 years old, approximately five feet in diameter and over 100 feet tall (see attached pictures). The driveway is about six feet from the base of the tree, thus hurting its roots. It's a shame to see this tree die and yet the builder does not seem to care. In fact this tree was not even on the plans of the landscape, despite the fact that it is the largest tree on the property and in the front yeard! Who can help us fight this?
Our house is over 100 years old and was luckily saved from being totaled to build new "mcmansions." We'd like to fight this construction but have met countless road blocks from the city and even the city's arborist, who didn't care much about our dilema. Any info or direction you could give me to help us save this tree would be greatly appreciated. Time is of the essence as they are currently buidling.

When weeding, the best way to make sure you are removing a weed and not a valuable plant is to pull on it. If it comes out of the ground easily, it is a valuable plant.

If this were my tree, I would seek legal advice on this issue and notify the developer that if the tree died, I would seek damages for loss of amenity and compensation for loss of real estate value. I would also seek asistance from a qualified arborist and ask for a written tree report on the condition of the tree. It might be worth having the tree estimated and valued. In the short term, I would mulch the whole area under the tree with straw, composted pine bark or forest mulch. I like forest mulch that comes from wood chippers the best but what ever is available. I would keep away from chook manures or any thing to rich or salty. Most arbortists would argue not to fertilize the tree particularly any thing high in nitrogen as this can do more damage than good. It may be worth watering the tree as well but I would seek advice from a local arborist before I would do any more.

Hi Elamb2al,

Hope it isn't too late for intervention on your oak. See a local lawyer about a property damage action and getting an injunction to prevent further damage. Make sure you document your concerns in writing to the builder and take plenty of photos.
