The root and base of an old lilac tree are on my property, but half of the limbs overhang my neighbor's property. My neighbor removed much of the tree structure that overhangs her property because she thought the tree was hers. My understanding is that whomever has the base of the tree owns the tree. Am I right?

Property issuses vary between municipalities. The customary one is that the imaginary line we draw (as Wolky comments in the next thread) is precieved to constitue ownership of the prtion of the plant.

In more progressive areas, there are ordinances where health of the plant must be taken into concideration where joint ownership is concerned.

The real question is do you want to make maters worse between you by taking her to court. One can sue for anything, and who knows you may set new presedent.
