There are many cases where preservation ordinances have been upheld. If you give us the jurisdiction you're working in, a usable precedent may be found for you. |

You want to look at a book titled "Tree Conservation Ordinances" by C. Durtksen with S. Richan, published by American Planning Association and Scenic America. aka Planning Advisory Service Report #446. Tree preservation ordinances are in basic terms valid exercises of police power as in zoning. Tree preservation ordinances can be overturned on technical flaws in the specifc langauge. This book identifies the issues. |
